COMMUNITY UPDATE

Proposed AI Data Centre - Wesley Vale

Council is aware of works currently being undertaken on the site of the proposed AI Data Centre at 174 and 226 Mill Road, Wesley Vale.

Based on information currently available, Council is concerned that some of the works may be occurring beyond the scope of the approved Forest Practices Plan for the site. Accordingly, Council has determined to issue a Notice of Intention to Issue an Enforcement Notice under the Land Use Planning and Approvals Act 1993. The Notice of Intention will be issued today, 25 September 2026.

As part of the regulatory process, Firmus will have an opportunity to respond to the Notice of Intention. In addition, Council's CEO and Compliance Officer have today contacted Firmus directly to request that works cease pending further assessment. It is understood that Firmus has complied with this request.

Questions have also been raised by members of the community regarding the status of the Major Project proposal. I can confirm that Council has not been advised by either the Minister for Planning or the State Planning Office that a decision has been made on that proposal.
